In 2011, the Department of Justice allowed states to pass legislation on online gambling. Twenty states now allow residents to wager on sports online.
The US Supreme Court ruled in favor of the states’ right to regulate gambling. Several court cases have been decided on the issue. Among them are United States v. Heacock, the 5th Circuit; United States v. Grey, the 10th Circuit; and United States v. Mick, the 6th Circuit.
A criminal case has been filed against Internet poker operators. They have been charged with violations of 18 U.S.C. 1955. These include money laundering and providing illegal Internet bets.
Since the advent of the Internet, online gambling has been growing fast. Today, millions of people gamble each day on different platforms. People play slots, roulette, and other games. Those who have won receive their winnings directly to their accounts.
There is debate over whether the Constitution guarantees free speech in the face of a violation of federal gambling laws. The Commerce Clause has raised doubts, but so have attacks based on the Due Process Clause. Despite this, these attacks have enjoyed little success.
